Employment Law: Rights and Responsibilities

Employment law governs the relationship between employers and employees, establishing minimum standards for workplace treatment, compensation, and termination. Both parties benefit from understanding their legal rights and obligations.

At-Will Employment

Most American employment is at-will, meaning either party may terminate the relationship at any time for any lawful reason. However, exceptions exist for implied contracts, public policy violations, and implied covenant of good faith in some states.

Office workplace

Employment contracts may modify at-will status, specifying terms of employment, grounds for termination, and severance provisions. Collective bargaining agreements override at-will employment for unionized workers.

Anti-Discrimination Laws

Title VII prohibits employment discrimination based on race, color, religion, sex, or national origin. The ADA protects disabled individuals, requiring reasonable accommodations. ADEA protects workers over forty. These laws apply to hiring, promotion, compensation, and termination.

Employment decisions must not be motivated by protected characteristics. Victims may recover damages, including back pay, front pay, compensatory damages, and punitive damages in cases of intentional discrimination.

Wage and Hour Laws

The Fair Labor Standards Act establishes minimum wage, overtime pay, child labor limits, and recordkeeping requirements. Non-exempt employees must receive overtime for hours worked over forty in a workweek. Exempt employees are excluded based on job duties and salary level.

Minimum wage must meet federal and state requirements, whichever is higher. Tipped employees may receive lower base wages with credit for tips. Certain industries have special rules governing overtime calculations.

Workplace Safety

OSHA requires employers to provide safe workplaces free from recognized hazards. Employers must comply with safety standards, provide training, and maintain records. Employees have rights to safe working conditions and may refuse dangerous work in limited circumstances.
